General Terms and Conditions
of Canna-Seed Handels GmbH
§ 1 Scope of application
(1) The following „General Terms and Conditions“ (GTC) apply in the version valid on the day of the order for all purchase contracts between Canna-Seed Handels GmbH and its customers. Deviating agreements must be made in writing. By placing an order, the customer agrees to these GTC and is bound by them.
(2) Should individual provisions of these GTC be invalid in whole or in part due to mandatory statutory provisions (in particular the provisions of the Consumer Protection Act), the remaining provisions of these GTC shall remain in full force and effect.
§ 2 Conclusion of contract
By placing an order, the buyer declares that he/she has reached the age of 18 and complies with the relevant legal provisions.
Canna-Seed Handels GmbH reserves the right to change the content of the respective service offer at any time. All offers of Canna-Seed Handels GmbH are subject to change and are to be understood as an invitation to the customer to submit an offer. The contract is concluded by acceptance of the order by Canna-Seed Handels GmbH, either by sending an order confirmation by post, fax or e-mail or directly by dispatching the ordered goods.
§ 3 Contract language
The content of the contract, all other information, customer service and complaint handling are always offered in German or English.
§ 4 Right of cancellation in distance selling
(1) Customers who are consumers within the meaning of the Consumer Protection Act may withdraw from the purchase within 14 days of accepting the goods without giving reasons. It is sufficient if the cancellation notice is sent within this period without stating reasons.
(2) In the event of cancellation, the purchase price shall only be refunded concurrently with the return of the goods received from the customer. The condition for this is that the goods are in an unused and resalable condition. The costs of returning the goods shall be borne by the customer.
(3) Canna-Seed Handels GmbH will charge an appropriate fee for the reduction in value for items that are impaired or damaged by signs of use.
(4) There is no right of cancellation for goods whose original packaging has been opened, modified or completely removed at the express request of the customer (in particular in the context of stealth shipping), as it is not possible to return them in a new and unmodified condition.
§ 5 Prices
(1) In principle, the purchase price for the ordered goods is deemed to be agreed, which results from the current brochures, catalogues, price lists, web shop and similar publications of Canna-Seed Handels GmbH.
(2) Unless otherwise stated, all prices are quoted as daily gross prices „ex works“ including the statutory value added tax and excluding all expenses incurred in connection with dispatch.
(3) Should export or import duties become due in the course of despatch, these shall also be borne by the customer. The prices for the deliveries and services offered do not include costs charged by third parties.
(4) In the case of sales to customers outside the EU, import duties may be incurred, which shall be borne by the buyer. In the case of sales to entrepreneurs within the EU, no Austrian value added tax is payable if proof of the UID is provided; the latter must pay the value added tax in their home country.
(5) Any insurance offered by Canna-Seed is subject exclusively to the conditions stated in the order process. The insurance is optional and only covers the loss of the shipment during transport by postal or parcel services. An investigation can be initiated at the earliest from the 28th calendar day after dispatch.
In the event of an insured event, only a one-off replacement delivery of the same value of goods will be made. There is no entitlement to payment of the value of the goods, credit notes or other forms of financial reimbursement. The insurance fee itself will not be refunded under any circumstances.
§ 6 Terms of delivery
(1) Delivery is normally made within 7 working days of the customer's order, but in any case within 30 days of the order date. If we are unable to accept an order - for example due to the unavailability of the goods - we will inform the customer immediately.
(2) Delivery shall be made to the address specified by the customer. In the event of incorrect, incomplete or unclear information provided by the customer, the customer shall bear all resulting costs.
(3) When accepting the delivery, pay attention to damage and complain to the courier or refuse acceptance. A parcel accepted by the customer with transport damage will not be taken back by Canna-Seed.
§ 7 Terms of payment
(1) Payment of the goods shall be made in advance to the account number provided by Canna-Seed. The purchase price including expenses is due upon transmission of the order confirmation and is to be paid immediately to the specified account.
(2) In addition to payment by bank transfer (prepayment), other payment methods are accepted. These include in particular credit card payment, cash payment by registered mail and cash payment by Western Union. All methods of payment are made in advance; the goods will only be dispatched once payment has been received in full.
(3) Settlement shall be made in euros.
(4) In addition, selected cryptocurrencies can be accepted as a means of payment. The currently available cryptocurrencies and the specific payment processing procedure will be announced during the order process. There is no obligation to accept certain cryptocurrencies.
§ 8 Liability
We ship our seeds on the condition that they are not used by others in contravention of local law. Canna-Seed Handels GmbH does not wish to incite anyone to commit unlawful acts. We emphasise that every buyer is responsible for his or her own actions. Canna-Seed Handels GmbH rejects any liability in this respect.
The seeds offered for sale are only intended for collection purposes for the preservation of the varieties or for cultivation for the production of textiles and building materials and not for consumption, inhalation or other physical use. Depending on availability and the amount of the order, we reserve the right to supply free samples of hemp seeds from various manufacturers, unless the customer specifies otherwise in the order notes.
In Austria, hemp seeds are not subject to the Narcotic Drugs Act. Unfortunately, the regulations and implementation regarding hemp seeds differ slightly in each country. We therefore strongly advise you to enquire about the regulations that may apply to you. Each customer is responsible for complying with the import regulations and the associated costs (e.g. customs, import duties, costs of an import licence or customs clearance) in their own country.
Complaints relating to germination rates, plant growth, harvest results or other properties of the natural plant material are excluded, as all hemp seeds are sold exclusively as collector's and souvenir items.
No advice is given on cultivation, germination, cultivation or other potentially unauthorised applications under local laws. Such enquiries will not be answered either by telephone or in writing.
Free sample seeds may be enclosed - depending on availability and order quantity. There is no entitlement to this.
§ 9 Applicable law
All legal disputes are subject to the law of the Republic of Austria; the application of the UN Convention on Contracts for the International Sale of Goods is excluded. Klagenfurt is agreed as the place of jurisdiction. The place of fulfilment for all parties to the contract is also Klagenfurt.
